Welcome to the My Muscle Chef platform (the Platform) which is provided to you by My Muscle Chef Pty Ltd (ABN 92 162 190 070) (“My Muscle Chef”, “we”, “us”, “our”). The Platform is accessible via our website or if you have downloaded and installed the My Muscle Chef app here onto your mobile device. The Platform provides information about our products and services and you can also open an account and order Products online to be delivered to you. Your use of this Platform and the supply by us of goods and services is governed by these terms and conditions together with our applicable policies, (altogether, the Terms). Please read the Terms (including the policies) carefully and contact us with any questions before you use the Platform. Our contact details are provided at the end of these Terms, (below).

A Binding Legal Agreement

  1. These Terms form a binding legal agreement between you, (our customer), and My Muscle Chef in respect of your use of the Platform and your purchase of Products from My Muscle Chef (Products). An Order refers to an order made by using functionality of the Platform, for the purchase and delivery of Products.
  2. Your use of this Platform indicates your acceptance of these Terms and any other applicable policy. If you do not agree to the Terms, please do not use this Platform.
  3. To the extent that any inconsistency arises between these Terms and a separate policy published on our Platform, these Terms will apply.
  4. These Terms take precedence over and wholly replace any subsequent terms or conditions provided by you or on your behalf to us in connection with an Order.
  5. My Muscle Chef reserves the right to make changes to the Platform and these Terms and the Products at any time.
  6. All dates and times referred to on our Platform or in any communication with you are references to AEST or AEDST as applicable, and all prices or other amounts are in Australian Dollars, inclusive of GST unless otherwise specified.

      1. 1. Licence to use Platform

    1. a. Our Platform provides information about My Muscle Chef and the goods and services offered by us. It also functions as an interactive ecommerce platform where you can register your personal information to open an account and order and purchase Products which will be supplied by us.
    2. b. We grant you a non-exclusive, non-transferable, royalty-free licence to use the Platform in accordance with its intended functionality and subject to these Terms.
    3. c. You must not add any content to the Platform:
      1. unless you hold all necessary rights, licences and consents to do so;
      2. ii. that would cause you or us to breach any law, regulation, rule, code or other legal obligation;
      3. that is or could reasonably be considered to be obscene, inappropriate, defamatory, disparaging, indecent, seditious, offensive, pornographic, threatening, abusive, liable to incite racial hatred, discriminatory, blasphemous, in breach of confidence or in breach of privacy;
      4. that would bring us, or the website, into disrepute; or
      5. that infringes the intellectual property or other rights of any person.
    4. The Platform may contain links to other websites including social media sites where there is content which has been created by people other than us. We do not endorse, sponsor or approve any such user generated content or any content available on any linked Platform.
    5. You acknowledge and agree that:
      1. we retain complete editorial control over the website and may alter, amend or cease the operation of the website at any time in our sole discretion; and
      2. the Platform will not operate on a continuous basis, and may be unavailable from time to time (including for maintenance purposes).

    1. 2. Registering and Opening an Account

    1. By opening an account and registering your personal details on our Platform, you will be able to place an Order for Products through our Platform.
    2. In order to use the Platform, you must provide us with certain information about yourself. We will handle and store this information in accordance with our Privacy Policy (www.mymusclechef.com/privacy-policy.html) and clause 18 of these Terms.
    3. You must:
      1. not use a false email address, impersonate others, or misrepresent your affiliation with others;
      2. not attempt to gain unauthorised access to computer systems or content through the Platform;not attempt to gain unauthorised access to computer systems or content through the Platform;
      3. not share login credentials (name and/or password) for your account on the Platform with any person;
      4. promptly notify My Muscle Chef in writing if you become aware of any unauthorised access to or use of your account by any person.
    4. As My Muscle Chef is an online food ordering service our primary means of communication with you will be via the email address and/or the mobile phone number listed on your My Muscle Chef account. My Muscle Chef will not be held responsible for any missed communication due to your contact details being incorrect. If you have more than one email address, please check all email accounts before contacting My Muscle Chef.
    5. As My Muscle Chef is an online food ordering service our primary means of communication with you will be via the email address and/or the mobile phone number listed on your My Muscle Chef account. My Muscle Chef will not be held responsible for any missed communication due to your contact details being incorrect. If you have more than one email address, please check all email accounts before contacting My Muscle Chef.

    1. 3. Your Responsibilities

    1. The responsibilities in this clause apply when you are placing an Order, unless otherwise stated. You must comply with the policies and procedures we publish on our Platform. You must comply with the policies and procedures set out in these Terms and or as published on our Platform from time to time.
    2. You must ensure that a Product which is ordered by you complies with any allergy or dietary requirements which are applicable to you or the person who will consume the Product. It is your responsibility to determine whether Products are safe and appropriate for consumption by you.
    3. You must comply with all Applicable Laws when using the Platform and purchasing Products.
    4. You must:
      1. you are legally capable of entering into this binding contract with us when you use the Platform and when you place an Order; and
      2. all information provided to us when you registered and during the time you remain registered as a customer or using the Platform is true, accurate, current and complete.
    5. You must not, in relation to your use of the Platform:
      1. interrupt or attempt to negatively impact or alter the operation of the Platform in any way;
      2. engage in any other practices which may adversely affect the credibility or reputation of the Platform and/or us;
      3. use the Platform in a way that violates applicable laws, that violates the intellectual property rights or other rights of us or others, or that is fraudulent, obscene, unprofessional, offensive, misleading or defamatory;
      4. reverse engineer, decompile or disassemble the Platform or use the Platform to develop a solution that is the same or substantially similar to the Platform;
      5. licence, sell, rent, lease, transfer, assign or otherwise commercially exploit, or otherwise make the Platform available to any third party;
      6. except as permitted under this agreement, modify, reproduce, display, publish, distribute, copy, transmit, perform, license, create derivative works from, transfer, or sell or resell any information, content, software, or materials made available through the Platform; or
      7. engage in any misleading or deceptive conduct or any other conduct that would contravene the Australian Consumer Law.
    6. If we believe that you have not complied with these Terms or any other agreement with My Muscle Chef at any time, we may immediately cancel any Order and/or terminate or suspend your access to your account. You agree that we may do so without prior notice to you and without liability to you or anyone else.

  7. 4. Intellectual property rights

    1. Nothing in these Terms constitutes a transfer of any intellectual property rights. You acknowledge and agree that, as between you and us, we own all intellectual property rights in the Platform.
    2. Images and text appearing on the Platform are protected by copyright and trade mark laws. Unauthorised copying or re-distribution of any materials on the Platform is not permitted. My Muscle Chef Pty Ltd, its affiliates and their respective licensors reserve all of their intellectual property rights throughout the world.

  9. 5. Our Liability to You

    1. To the fullest extent permitted by law, we exclude all liability, in contract or tort (including negligence), arising in connection with our Platform, Products, or services or these Terms, including any liability in respect of interruption of business, viruses and other harmful components within the Platform or content, loss of data or any indirect, special, punitive, consequential, incidental or similar damages arising from your use of this Platform or its content or services, or from the purchase or supply of any Products.
    2. To the full extent permitted by law, we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these Terms.
    3. These Terms may be subject to legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions, guarantees or obligations (such as the non-excludable provisions of the Australian Consumer Law (contained in Schedule 2 of the Competition and Consumer Act 2010)). If such legislation applies, to the extent possible, we limit our liability in respect of any claim to, at our option:
      1. in the case of Products:
        1. the replacement of the Products or the supply of equivalent Products;
        2. the repair of the Products;
        3. the payment of the cost of replacing the Products or of acquiring equivalent Products; or
        4. the payment of having the Products repaired; and
      2. in the case of services:
        1. the supply of the services again; or
        2. the payment of the cost of having the services supplied again.
    4. In respect of any liability which cannot be excluded in accordance with the above provisions, then we limit such liability, where lawful, to payment in the amount of $10 or the minimum amount permissible by law (if greater than $10).

Your Liability to Us

You are liable and solely responsible for:
  1. verifying the accuracy of any information which you supply to us and ensuring that you have all necessary consents from any third party;
  2. your breach of any person's intellectual property rights (including those of My Muscle Chef);
  3. Your breach of these Terms or any other agreement with us; and
  4. Your breach of any applicable law.
You agree to indemnify My Muscle Chef (including our directors, employees, contractors, assigns, and related bodies corporate) (Indemnified Parties) from and against any and all claims (including in negligence), liabilities, costs, expenses (including legal fees) and loss suffered or incurred by the Indemnified Parties and arising in any way from any of the matters set out in paragraphs (a) – (d) above. We reserve the right, at our own expense, to assume the exclusive defence and control of any third party claims or matter which is otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defence of such claims.

One-off orders and first order in a subscription

  1. Our service offering requires the use of fresh ingredients and the preparation of meals made to order. On Order Confirmation your Order is committed to processing in our kitchens, our logistics facility, and with our third-party suppliers.
  2. To avoid food wastage, subject to the non-excludable provisions of Australian Consumer Law, you are unable to change or cancel your one-off Order or the first Order in a subscription / Recurring Order sequence after the Cut-Off Period begins.
  3. For the avoidance of doubt: (a) Cut-Off Period begins once Order Confirmation takes place, which is once you have selected “Confirm Order” on our website or mobile app (Order Confirmation). (b) No Refunds or Changes to orders are permitted once the Cut-Off Period begins.
  4. You are responsible for your selections in accordance with the Order Confirmation, Cut-Off Period and the No Refunds or Changes terms above. Before you select “Confirm Order” on our website or app, please ensure that you are aware of the following: (a) Order Confirmation is final; (b) The contents of your Order; (c) Order delivery address and timings that you have selected including day and delivery time window; and (d) Order type that you have selected, i.e. one-off order or recurring subscription order.

Recurring Orders (subsequent Subscription orders after the first Subscription order)

  1. You can edit, skip, reschedule, change or cancel your upcoming Recurring Order (i.e. any subscription order after the first order) any time before the Recurring Order Cut-Off Period.
  2. For the avoidance of doubt: (a) The Recurring Order Cut-Off Period begins when we charge your credit card or selected payment method for a Recurring Order (i.e. you have selected a recurring order every week, fortnight or month). (b) No Refunds or Changes: once the Recurring Order Cut-Off Period begins your order is committed to processing in our kitchens, our logistics facility, and with our third-party suppliers. To minimise food wastage, subject to the non-excludable provisions of Australian Consumer Law, you are unable to change or cancel a Recurring Order once the Recurring Order Cut-Off Period begins. (c) Future Recurring Orders for the subsequent week, fortnight or month, can still be changed or cancelled via your account profile on our website or mobile app.
  3. Timing of Credit Card / Payment Method Charges for Recurring Orders: Your credit card or selected payment method will be charged on the same day every week, fortnight or month. If your credit card provider declines our request for payment for any reason, then the charge dates may vary.
  4. Email Reminders: You will be reminded via email the day prior to your credit card or selected payment method being charged for the Recurring Order.
  5. Check your Email Settings: To ensure that you receive payment notice communications, it is your responsibility to check that your email address is correct, your inbox is not full, and the emails are not diverted to your email spam folder. My Muscle Chef uses email delivery validation software to determine whether you have received and or opened these email notices.
  6. Free Shipping: To be eligible for free shipping on Recurring Orders (including the first order in a Subscription sequence), you must meet the minimum Order requirement of $99 (excluding promotional discounts and deliveries to Western Australia and Tasmania). Deliveries to Western Australia and Tasmania must meet the minimum Order requirement of $149 (excluding promotional discounts).

Delivery

  1. We deliver to areas in ACT, NSW, QLD, SA, VIC, WA and TAS. A flat rate delivery fee is charged for each delivery based on your suburb. You can get more information about our delivery regions and delivery fees on our Delivery Page.
  2. In order to effect delivery of your Products we may elect to engage a third party contractor and you agree to our use of a third party contractor at our sole discretion.
  3. If you are not home at time of delivery we will leave the Order at the front door or in an area specified by you in the instructions when placing your Order. The ice packs in the box mean that it can usually be left in a shaded area for up to 5-8 hours. This is a guide only and may change depending on weather, temperature and other ambient conditions. My Muscle Chef Pty Ltd will not be liable for damage to the Products arising because they were left outside or if the box is damaged or stolen after delivery. The entire risk in the Products passes to you when the Products are delivered to your address.
  4. It is your obligation to enter the correct delivery address details at time of ordering. If you enter the wrong address, we are not obliged to re-send the Order to the correct address at our expense.
  5. We will provide you with an estimated date of delivery of your meals and will make every reasonable effort to deliver on this date. We use third party contractors to perform delivery services and many aspects of the delivery network are beyond our control. We will not be held liable for any loss or damage resulting from late delivery.
  6. If you live in a secured apartment complex, please ensure you are home to receive your delivery.
  7. It is the responsibility of the customer to inform My Muscle Chef Pty Ltd by calling us if an Order does not arrive. Our contact details are provided at the end of these Terms, (below). Once we learn an Order has not arrived on the due date, we will make enquiries and use reasonable efforts to arrange delivery as soon as possible thereafter. We will not be held liable for any loss or damage resulting from late delivery.

Payment

  1. Any transactions or purchases online can be made via American Express, MasterCard, Visa and Paypal and Zippay. We reserve the right to vary accepted payment methods at any time and without notice to you. All transactions are processed via our partner payment service Braintree Payments (a Paypal company; You can view their terms here) or where relevant, by Zippay. In order to secure payments for future purchases, in particular when you opt in for our recurring Order (subscription) service, tokenised payment information is securely stored on our servers. My Muscle Chef Pty Ltd never stores the actual card information on our servers and all payments are processed via a PCI compliant payment gateway.
  2. All payments must be received by My Muscle Chef before your Order can be processed and delivered. When paying by card, if you have insufficient funds in your account or the card declines - the Order will not be processed. For direct transfers, your Order will only be delivered once the transfer has been completed.
  3. If you cannot pay using the methods above, please contact us and we can try to organise a solution for you. Our contact details are provided at the end of these Terms, (below).

Credit Card Security

  • All credit card payments are processed securely through a PCI compliant payment gateway Braintree Payments (a Paypal company) to ensure your personal details are kept safe. Zippay purchases are processed by Zippay. My Muscle Chef Pty Ltd does not store any credit card information on our servers. We reserve the right to vary our payment gateways at any time and without notice to you. We take reasonable steps to protect your personal information. However, we are not liable for any unauthorised access to this information.

Returns Policy

  1. This policy includes rights you are entitled to under Australian Consumer Law.
  2. If you experience a problem with any of the Products received or if the Products you receive are different to what you ordered, or are otherwise not as expected, please contact My Muscle Chef Customer Support immediately. Our contact details are provided at the end of these Terms, (below).
  3. If you have received an item that is incorrect, damaged or faulty we require notification as soon as possible after the time the delivery was made. My Muscle Chef may require reasonable evidence of the error, damage or defect and may, in some circumstances, require you to return the item for assessment.
  4. My Muscle Chef is not obligated to accept a return or otherwise compensate you:
    1. because you have had a change of mind; or
    2. for damage to the Products arising because they were left outside or if the box is damaged or stolen after delivery. The entire risk in the Products passes to you when the Products are delivered to your address. Refer to Delivery (clause 8, above).
  5. Account credits and refunds for an approved return will only apply to the Products which are defective and will not cover other Products in your Order or any return postage costs or your original shipping charge.

Account Credit

  1. In some circumstances My Muscle Chef may offer you credit on your account (for instance as compensation or as a reward for a referral). Account credit is separate from and different to the credit which you receive when you purchase a Gift Card.
  2. In all cases, if you receive a credit on your account, that credit:
    1. must be used solely to pay for Products and services purchased from My Muscle Chef in conjunction with your account;
    2. is never redeemable for cash;
    3. cannot be transferred, resold, or exchanged; and
    4. will expire if it is not used within 90 DAYS from the date on which the credit was applied to your account.
  3. If you wish to close your account and your account is in credit then you may use that credit to purchase Products or services prior to closing the account. Alternatively, the unused credit will be forfeited immediately upon closure of your account and without further compensation to you. Remember, you must use account credit within 90 DAYS from the date on which the credit was applied to your account

Discounts and Promotions

  1. From time to time we may run various promotional campaigns aimed at introducing customers to our product range and/or otherwise improving our business. The campaigns may be in different forms and may provide incentives like account credit (referred to above), promotional codes or discounts.
  2. Account credit, discounts or promotion codes are non-transferable and cannot be transferred, resold, or exchanged for cash.
  3. My Muscle Chef Pty Ltd reserves the right, subject to applicable law, to cancel any promotion or discount without prior notice.
  4. Only a single discount or promotion code is allowed per order and any such code cannot be used in conjunction with any other discounts or promotions.
  5. The ‘Chef’s Specials’ prices are only valid for orders placed and processed during the Promotional Period or until the allocated stock has been sold. Orders made before or after the Promotional Period will not be eligible for the promotional pricing. The specific products, promotional prices, and duration of the Promotional Period remain active only as long as these details are displayed on our website and app. While stocks last. Items per order limit applies.

Profile Survey Winner

  1. 1. Promoter
  2. The promoter is My Muscle Chef Pty Ltd (ABN [92 162 190 070], “My Muscle Chef”), operating in Australia.
  3. 2. Eligibility
  4. Entry is open to Australian residents aged 18 years or over who are existing customers of My Muscle Chef and have placed at least one (1) order. Employees of the Promoter and their immediate families are not eligible to enter.
  5. 3. How to Enter
  6. To enter the draw, eligible customers must complete the “Complete Your Profile” survey questions in full during the calendar month. Limit of one (1) entry per customer per calendar month. Duplicate entries will be disregarded.
  7. 4. Draw and Prizes
  8. Each month, five (5) winners will be drawn at random during the first week of the following calendar month (e.g. entries submitted in March will be drawn in the first week of April). Each winner will receive a $50 My Muscle Chef credit, which can be used on any purchase of $99 or more. Credits can be used in conjunction with other offers.
  9. 5. Prize Conditions
  10. The $50 credit is:
    • Valid for 90 days from the date of issue.
    • Not transferable, exchangeable or redeemable for cash.
    • Only valid for orders with a minimum order value of $99 (excluding delivery fees).
  12. 6. Notification of Winners
  13. Winners will be notified via the email address associated with their My Muscle Chef account within 7 days of the credit being applied. It is the entrant’s responsibility to ensure their email address is up to date.
  14. 7. General
  15. The Promoter reserves the right to verify the validity of entries and entrants and to disqualify any entrant who tampers with the entry process or breaches these Terms and Conditions. The Promoter reserves the right to modify, suspend, or cancel the promotion if necessary.
  16. 8. Privacy
  17. Any personal information provided will be handled in accordance with the My Muscle Chef Privacy Policy, available at https://www.mymusclechef.com/privacy
  18. 9. Liability
  19. To the extent permitted by law, the Promoter shall not be liable for any loss or damage arising from participation in this promotion or use of any prize.

Referral Program Conditions

  1. Any customer who has previously placed orders with us can become a member of our Referrer Program.
  2. As a member of our Referrer Program, you will be provided with a unique Referral Code, which you can share with friends, family, and anyone else who you think might be interested in trying My Muscle Chef meals. If a new customer quotes your Referral Code when creating an account on our Platform or making a purchase: (a) that new customer will be given a credit for $20 off their first Order; and (b) you, as the Referrer, will receive $20 in credit to apply towards your Orders.
  3. You are limited to one credit per new customer, and each new customer much be a genuinely unique, first-time customer of My Muscle Chef.
  4. Credits cannot be redeemed for cash or other consideration and cannot be transferred, resold, or exchanged.
  5. The maximum total credit that can be earned by a Referrer in any 12-month period or held by a Referrer at any time is $500.00. You will not be awarded any credits for use of your Referral Code once you reach the 12-month maximum, or while you hold $500.00 in unredeemed credits. We may otherwise reset or reduce your credit balance in accordance with those maximums at any time.
  6. Referral Program credits for both new customers and Referrers are available to individuals over 18 only (and not to businesses, companies, or organisations).
  7. We do not guarantee the availability of the Referral Program or your ability to receive or redeem credits. You acknowledge and agree that we may cancel our Referral Program, change the terms of the Referral Program, remove credits, or terminate your Referral Code and/or membership of the Referral Program at any time at our sole discretion with or without notice. Upon such cancellation or termination by My Muscle Chef, unredeemed credits of relevant new customers and/or Referrers will be automatically void and non-redeemable (except to the extent otherwise expressly specified by My Muscle Chef in its sole discretion)

Save up to $120 Multi Order Promotion - First Order

  1. 1. Description of the SAVE120 Offer and BALLMAGNETS120 (“Offer”):
  2. Offer: New customers receive up to 15% off their First Order (discount capped at $20) and up to 10% off (discount capped at $20 per order) each of their next five (5) eligible orders (Subsequent Orders) made within 28 days of the prior eligible order.
  3. Eligible Order Timing Requirements:
    • Customers must place their second order (i.e. the first Subsequent Order) within 28 days of their eligible First Order to claim a second discount of 10% (discount capped at $20 per order).
    • Subsequent Orders must be placed within 28 days of their prior eligible Order to claim the discount of up to 10% for each of those eligible Subsequent Orders (each order discount capped at $20 per order).
  5. The value of the total Offer discount across all six (6) eligible orders (First Order and Subsequent Orders) that meet the terms and conditions of the Offer can amount to up to $120. The total potential Offer discount value of up to $120 cannot be stacked or redistributed in any way outside of these terms, and discounts are capped at $20 per Eligible Order.
  6. Eligible Orders must be paid for by the Customer and successfully delivered to them to trigger eligibility for any Subsequent Order discounts under the Offer.
  7. 2. Eligibility Criteria:
  8. New Online Customers Only: this Offer is available exclusively to new online customers to My Muscle Chef’s consumer facing online service located at its website (mymusclechef.com) and mobile application.
  9. No discount stacking: the Offer cannot be combined with any other discount codes, referral codes, discounts, incentives, commissions, corporate discounts or other relevant promotions offered by My Muscle Chef or its partners, nor can the initial First Order discount be combined with the eligible Subsequent Order discounts.
  10. No gift card purchases: the Offer cannot be used in the purchase of gift cards from My Muscle Chef.
  11. Customers with eligible orders under this Offer are still eligible to receive Free Shipping on eligible recurring orders in accordance with the Terms.
  12. 3. Order Requirements:
  13. A minimum order value of $99 (excluding any shipping costs, excluding gift card purchases) and before any Offer discount is applied is required to qualify for the Offer discounts.
  14. The code SAVE120 and BALLMAGNETS120 is only needed to be entered at a customer’s eligible First Order. Subsequent Orders will automatically receive a discount of up to $20 per order. For the avoidance of doubt:
    • To trigger the Offer discounts the Customer must enter the code SAVE120 or BALLMAGNETS120 at checkout of an eligible first order at mymusclechef.com or the My Muscle Chef mobile app and complete payment for that order. No code is required for eligible Subsequent Orders – the relevant Subsequent Order discount will be applied automatically in accordance with the Offer Description above.
    4. Duration and Validity:
  15. The Offer is ongoing and does not have a specified end date. However, My Muscle Chef reserves the right to cancel or modify the terms of the Offer at any time without prior notice at its discretion.
  16. Customers will be notified by email of any significant changes to or termination of the Offer in a manner deemed appropriate by My Muscle Chef.
  17. 5. Marketing and Communication Channels:
  18. The Offer will be communicated to potential customers through various channels including email, SMS, mobile app push notifications, social media and targeted digital media advertising at My Muscle Chef’s discretion and in accordance with its Terms, Privacy Policy and any relevant legislation.

Save up to $120 Multi Order Promotion - Selected Customers

  1. 1. Description of the Offer Promotion:
  2. Offer: Selected Eligible customers receive up to 15% off their first eligible order (New Offer Order) in the Offer Promotion order sequence (discount capped at $20) and up to 10% off (discount capped at $20 per order) each of their next five (5) eligible orders (Subsequent Offer Orders) made within 28 days of the prior eligible order.
  3. Eligible Order Timing Requirements:
    • The New Offer Order must be placed within 28/08/2024 - 31/10/2024
    • Customers must place their second order (i.e. the first Subsequent Offer Order) within 28 days of their eligible First New Order of the Offer Promotion to claim a second discount of 10% (discount capped at $20 per order).

Gift Cards

  1. My Muscle Chef offers Gift Cards which are available for purchase through multiple different third party vendors and on this Platform. Gift Cards are redeemable by the holder of the Gift Card for Products and services available on our Platform, up to the value of the stored value associated with that Gift Card.
  2. In order to redeem the stored value on a Gift Card, the holder of the Gift Card may be required to register and open an account on our Platform.
  3. If you purchase a Gift Card, the stored value on that card:
    1. must be used solely to pay for Products and services purchased directly from My Muscle Chef;
    2. is never redeemable for cash;
    3. cannot be transferred, resold, or exchanged; and
    4. will expire if it is not used within THREE YEARS from the date on which the Gift Card was purchased.
  4. A Gift Card which has been lost, stolen, damaged or used without permission cannot be replaced.
  5. After expiry, a Gift Card cannot be used and the stored value cannot be redeemed.

Declining an Order

  1. We reserve the right not to provide Products or services, or to cancel an Order (or part thereof) at our sole discretion at any time.   3. Each party must at its own expense do everything reasonably necessary to give full effect to this Agreement and the events contemplated by it.

Terms and Conditions:   1.          The entrant agrees and acknowledges that they have read these Terms and Conditions (which include the Details Schedule) and that entry into the Promotion is deemed to be acceptance of these Terms and Conditions. Information on how to enter and prizes form part of these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid. 2.          Capitalised terms used in these Terms and Conditions have the meaning given in the Details Schedule. 3.          The Promotion Period commences on the 29.03.25 and ends on the 30.03.25. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt. 4.          Valid and eligible entries will be accepted during the Promotional Period. 5.          To enter, an Eligible Entrant must submit an entry in accordance with the competition details, providing a response to the game of skill challenge as set out below: a)          Game of Skill: This is a game of skill as per the Judging Criteria set out in the Details Schedule. Chance plays no part in determining the winner. b)         Only one entry per Eligible Entrant. c)          The Promoter and/or judges reserve the right to disqualify anyone engaging in unsafe behaviour, inappropriate or disruptive conduct, uses unfair means of participating or violating the competition terms and conditions. d)         Disqualification may occur at any time. e)          The judges’ decision is final and no correspondence will be entered into.  f)            The games of skill between competitors will be run during opening hours at the convention during the promotional period.  The number of participants that can be accepted to entere is time dependant and will be determined by how quickly the paired entrants finish their mini comps. 6.          To the fullest extent permitted by law, Eligible Entrants participate in this Promotion and the Winners use the Prizes, at his or her own risk. 7.          The Prizes are as set out in the Details Schedule  - the prizes are not transferable, exchangeable, or redeemable for cash. The winner is responsible for any additional costs associated with using the prize. The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date. 8.          If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and specification. 9.          The winner is announced on the spot at the conclusion of each mini battle royale between two Eligible Entrants and shall be awarded their prize pack on the spot.  If the winner does not accept their prize, the Promoter reserves the right to award the prize to the other participant. 10.    No entry fee is charged by the Promoter to enter the Promotion. 11.    Each prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner. 12.    Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at https://www.mymusclechef.com/privacy. The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. 13.    The entrant agrees that will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them. 14.    It is a condition of accepting the prize that a winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize. 15.    The winner should look to the manufacturer of products and provider of services awarded as prizes for all warranties. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). 16.    Employees (and their immediate family members) of companies directly associated with the conduct of this Promotion, the Promoter, businesses involved in determination of winner/s for the Promotion, businesses involved in the management of the Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. For the purposes of this term “immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, sibling or step-sibling. 17.    If for any reason any aspect of this Promotion is not capable of running as planned, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize. 18.    The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid. 19.    The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. 20.    In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final. 21.    The Promoter and its associated companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 22.    The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize. 23.    Failure by the Promoter to enforce any of its rights does not constitute a waiver of these rights. 24.    These Terms and Conditions are governed by the laws of the State of Victoria.
